Vote Results

191 Owners cast their vote by proxy, and 105 Owners cast their vote in person. Approximately 75 Owners chose to stay, ask questions, and share their thoughts.

On Saturday, September 7, 2019, a “Special Meeting” was held at the Waterford Pool to determine how the Owners wanted to handle the recent discovery that Waterford’s governing documents (written in 1984) state that “use of Common Properties shall be limited to that of the Owners, tenants of Owners, and their guests.”   According to the opinions of legal counsel, the HOA’s current practice of selling pool memberships to the public was likely occurring outside of bylaw guidelines. A vote was held to determine whether to:

  1. Amend the bylaws to eliminate the text, “use of Common Properties shall be limited to that of the Owners, tenants of Owners, and their guests”.
     
  2. Amend the bylaws to allow only a limited number of public memberships to be sold, and increase Owners annual HOA dues to $380 which would include full pool access to all Waterford Owners.
     
  3. Increase Owners annual HOA dues to $480, which would include full pool access to all Waterford Owners and their guests at no additional charge.

70% of the 429 Owners either attended the special meeting or voted ahead of time by proxy. Of the 296 possible votes in attendance or submitted by proxy;  171 voted for Option 1; 47 voted for Option 2; 75 voted for Option 3; and 3 abstained. 

Thus, of the votes cast, 57% were for option #1.  The threshold for Option 1 to pass was a simple majority, so Option 1 passed.  The Board will therefore amend the Bylaws pursuant to Option 1.

FACTS:

  1. Waterford has been selling pool memberships to the public.
  2. Waterford’s governing documents say that the Waterford amenities are, “…for the exclusive use of homeowners, tenants, and their guests.”
  3. The 1985 developers intended for the Waterford pool to be exclusive to Waterford homeowners, but began selling memberships while the neighborhood was developing, and the surrounding areas were mostly rural.
  4. Now that the surrounding areas are populated and Waterford is fully built; should we return the pool exclusively to its 429 owners (and their guests) or change the documents to allow public access to our amenities?

Hello Neighbors – The Board of the Waterford Homeowners Association is going to host a neighborhood “town hall” style discussion at the Clemmons public library at 5:30 on March 27th. There will be two primary discussion items.

First, upon review of the neighborhood bylaws and covenants it appears that the neighborhood swim club was never intended to be or allowed to be open to outside members. This has been confirmed by an attorney hired by the Board to review the documents. Because membership information and applications have already gone out for the 2019 pool season, we will continue offering outside memberships for the upcoming 2019 pool season. However, the HOA needs to begin the process of coming into compliance with the governing documents. Within the next 10 months a choice needs to be made by the homeowners whether to: 
a) permanently amend the documents to permit outside membership or 
b) increase annual HOA dues in an amount sufficient to support swim club operations without outside members. 
The Board intends to be neutral and simply present the facts and pros/cons of each alternative until such time at which the matter can be put to a vote. There are strong opinions on both sides, and participation in the process is encouraged beginning with attendance at the March 27th meeting.

Secondly, the Village of Clemmons would like for Waterford to consider allowing them to install a pedestrian/bike lane on one side of the road along major neighborhood thoroughfares. This is recommended as a safety and traffic calming measure, and it may be appealing to residents that regularly walk/run/ride/dog walk along Waterford’s sometimes busy streets. The Board hopes to provide information and get preliminary questions and reactions on the 27th so that it can continue to evaluate the opportunity before coming back to the homeowners with a recommendation.

We look forward to seeing as many homeowners as possible at 5:30 on March 27th at the Clemmons Public Library. Light refreshments will be served.

New Subdivision

The “Bartlett Bluff” subdivision is currently under development directly across from Center Grove Church and will connect with Waterford through Kilrush Road. The future community runs behind and parallel to Rossmore Road. While we welcome our future neighbors, Waterford homeowners on Rossmore Road may experience increased stormwater runoff until all storm water retention items have been installed.
With the addition of several new upscale subdivisions, our HOA’s goal is for our Waterford neighborhood to remain as competitive as possible. As a result, some reinvestment in our established Waterford community may be necessary to retain our reputation and “A” rating. Ask yourself, why would families choose to buy here in Waterford over a neighboring subdivision? Please consider volunteering in one of the committees to see that happen. Our pool improvement committee did a fabulous job improving our pool area this year. Kudos to them! A holiday commitee is already working up plans to decorate the Waterford entrances for the holidays. Another committee is forming to compile the pros/cons of making the pool exclusive to only Waterford homeowners. Yet another began the process of planning a Waterford-only playground. Other committees might include one to attain bike lanes throughout the neighborhood. We welcome your participation.

Neighborhood Yard Sale – March 17 and 18

Waterford residents are welcome to participate in the annual Waterford Neighborhood Yard sale on March 17 and 18. No extra signage will be needed by you as the HOA will be placing them on all approaches. The bulky item pick-up will be the following week so you/ll be able to leave those items that you don’t want on the curb. Pick-up is March 19th.
